Woman to Loganville Police: Marijuana Is Not Pot, and It's Not Illegal

Authorities originally reported to her home on a domestic disturbance call, but ended up charging her with marijuana possession.

A Loganville woman tried to get out of being charged with marijuana possession by convincing officers that the drug was not illegal and is "everywhere." 

According to the Loganville Police report, authorities responded to her home off Alexander Crossing on a domestic disturbance call last week. The local woman, 39, told police that she and her husband were having a party outside with some family members and they were just trying to have a good time. 

While the officer spoke to her, he smelled the odor of marijuana and found, in plain view on the back porch, a rolled up cigar that smelled like the drug.

When questioned about the cigar, the husband became nervous and said he didn't know what was in it and he had just gotten home. The woman told officers that a lot of people were over at the house earlier and they must have left it behind. She also backed up her husband, saying not only that he had just arrived and had no idea what was going on, but also that he was a Pine Lake Police officer. 

The officer then openly asked everyone in the home what was in the cigar, and the wife became upset.

"I don't know why you guys are making such a big deal about this because marijuana is not pot!" she said, according to the report. "Marijuana is everywhere! It's not illegal!" 

The officer told the husband to control her and asked again who the cigar belonged to. The wife said she would take responsibility for it since they were in her home. 

The woman was arrested and charged with less than 1 ounce of marijuana possession. Police found another partially burnt marijuana cigar in the home.

I guess it now depends on what state you live in that dictates weather it is legal or not.

Could you share a legal precedence / legal site that states the law regarding this? I'm just curious as to when this went into effect in Georgia?

Not real clear as to whether medical marijuana is legal in Georgia or not but I think it would be best not to be found in possession of it. ----- http://www.gacareproject.com/georgias-plan-to-legalize-medical-marijuana/
