Loganville Man Faces Charges In Car Wreck From Last Year

Accident, which happened in Duluth last year, resulted in the death of an 83-year-old Lawrenceville woman.

A Loganville man is in the Gwinnett Detention Center facing vehicular homicide charges resulting from a fatal car accident that happened in Duluth last year.

According to Cpl. Edwin Ritter, public information officer with the Gwinnett Police Department, Josue Amilcar Duarte of 3695 Claude Brewer Road, Loganville, was booked into the Gwinnett jail yesterday. He was already being held without bond in another jurisdiction on charges of theft by receiving, theft by conversion and failure to appear. Ritter said he didn’t know where those charges originated.

“He was transported to Gwinnett County Jail by a prisoner transport company yesterday regarding these old charges,” Ritter said. “The vehicular homicide charge was a fatal accident we worked last year in Duluth.”

According to the police report, the accident took place on Club Drive in Duluth on June 11, 2010, and resulted in the death of 83-year-old Ethel McDaniel of Lawrenceville. Duarte allegedly turned left into the path of the vehicle driven by McDaniel on Club Drive at the intersection of Kibbie Circle. Both vehicles ended up in the ditch on the southbound side of Club drive and Duarte and McDaniel were transported to Gwinnett Medical Center. Duarte's injuries were non-life threatening, but McDaniel was critically injured.

“She died later from the injuries sustained in the accident,” Ritter said.

A cash bond of $5,700 was set on the vehicular homicide charge as well as security bonds of $700 for no driver’s license and $1,300 for obstruction of a law enforcement officer respectively.
