Accused Murderers of Loganville Woman Back in Court

Pretrial motions resume Thursday in the death penalty case of three Monroe men accused in the 2009 murder of 65-year-old Epsie Ewing.

On May 21, it will be three years since 65-year-old Epsie Ewing and her husband, C.F. Ewing, were attacked and beaten in their downtown Loganville home. The attacks happened in broad daylight. Epsie Ewing did not survive her injuries and died the following month. The three men accused of the murder were arrested even before she had succumbed to her injuries, but her family said they are still waiting for “justice for Epsie.”

“She is still missed dearly and this May will mark three years since she was brutally beaten and later died on June 23rd," said her sister, Faye Evans. “Unfortunately we don’t know any more now then we did then. It’s as if everybody has forgotten about her. Please don’t let her slip through the cracks.”

Evans did say that pretrial motions in the case of the three Monroe men accused in the case will resume this week.

“To my knowledge the only things that will be discussed on these two days are motions for the three guys,” Evans said. “We have no idea when we may get a trial date.”

Walton County District Attorney Layla Zon confirmed that the three accused - Cory Butler, John Jodie Blackwell Jr., and Barry Marquez Partee - will be in court at 9 a.m. Thursday to resume pretrial motions. March 8 and 9 have been set aside to hear the motions. All three men face the death penalty, charged with malice murder, three counts of felony murder, aggravated battery, two counts of aggravated assault, two counts of false imprisonment, armed robbery, burglary and two counts of possession of a weapon during the commission of a crime. Butler faces an additional charge of a convicted felon being in possession of a weapon.

According to earlier court testimony, Epsie Ewing’s husband knew Butler. The three men went to the Ewing's home on the pretext of wanting to purchase a truck. After taking the truck for a test drive, they are accused of forcing C.F. Ewing back into the home at gunpoint, where the beatings are alleged to have happened.

A neighbor called the police after seeing the subjects flee the scene. C.F. and Epsie Ewing were taken to the hospital. C.F. Ewing was released the following day, but his wife did not survive her injuries. The three suspects were arrested within a week of the attacks and have remained behind bars ever since. Former District Attorney Ken Wynne called for the death penalty against all three.

Zon took over the case, which is now going into a third year. Pretrial motions were halted last year pending finalization of the census count. This was necessary for motions by the defense challenging the racial make up of the jury. The three accused men are black. Blackwell and Partee were teens at the time of the attack and Butler was in his late 20s. Another challenge by the defense still to be heard is the constitutionality of death by lethal injection. It also is possible that Butler could mount a mental health/mental retardation defense.

Zon said the pretrial motions have dragged on because all three defendants have had to appear together for these motions and scheduling all the attorneys at the same time has proved difficult. All three are represented by public defenders. Zon said once these final motions have been settled, however, dates would likely be set for the trials to begin. At that time, the three men would be tried separately.

This is such a horrific story....and Epsie deserves justice!!!! It is unimaginable that this has not gone to trial yet & some of these motions are completely absurd! I know exactly what this family is going through, my sister was murdered 6yrs ago n April. no arrest have been made in her case, but the wounds dont heal.....I urge any one with a vioce to speak up about this, it could have been your sister, mom, daughter! Lets help by being a voice for justice, a voice for Epsie! My prayers are with you & your family Faye, and that this will be over soon!

It breaks my heart that this family has lost a dear loved one. Reading what was done to her was horrific, it is my understanding they beat her so badly and showed no mercy to this elderly woman. I pray these men get what they deserve, NO MERCY shown to them. Three men against one elderly woman, come on they do not qualify as men, they are evil mean criminals.

Really everything they come up with to postpone this, she had no chances. I hope the justice system will stop falling for all this crap and give her justice. These men all deserve the death penalty and should stop being postponed. This family has suffered enough. And just when is enough going to be enough? Thoughts and prayers going out for all the family.

The victims never have as many rights as the thugs who commit this type of violence. This is wrong! Death is too good for these monsters. Their death will be swift where Mrs. Ewings suffered till her death. I know the family will not rest in peace until justice is served. God bless each of you and pray HE gives you the strength to keep holding on.

This happens all to often. The victims and their families keep getting victimized over and over, while the defendants get their three meals a day, a roof over their head, outside privledges, television/phone and visitation time etc....!!! We need to bring back an EYE FOR AN EYE in justice and stop catering to all these deadbeats. Faye is one of my best friends and it hurts to see her and her family having to go through all the bull! These three boys who like to beat on elderly women need to be brought to justice immediately, it has been dragging on too long already. Time to put them under the jail!!!!!!! My love and prayers are with you Faye and your family. To put them to death would be too good for them, let's make them suffer like they did Epsie. JUSTICE FOR EPSIE NOW!!!!!!!!!!!!!!!!!!!!!

I hate to say this, because I can't prove it, but my Grandmother (Nanny) (Epsie Ewing sister) has a terrible case of Alzheimer’s disease. While doing research about this disease. I realized that Alzheimer's stays dormant for many many years and in most cases a switch in the brain is triggered by a shock or abnormal change in someone's life. My grandmother was showing small signs of this disease just before Aunt Epsie's passing and then my Grandmother went off the deep end right afterwards. So on top of those three men taking Aunt Epsie away from her family. They unknowingly took Nanny away from her family and even herself. I can't say for sure, but it is very unlikely she would have progressed to this stage of Alzheimer's in only 3 years. I know how much she misses her sister and that is all she would ramble on and on about, day in and day out for months after all this happened. I miss seeing Aunt Epsie and how much my Nanny would talk to her. They talked at least once a day on the phone. But I miss my Nanny and how she was before all of this. Love you both a lot and miss you both. One day Nanny and Aunt Epsie will be together again and I will miss them both more.

thank you jarid, and i know how much you miss your granny, so do all her brothers and sisters.....its like we lost 2 sisters at one time and you lost a grandmother. your grandmother still talks about her and for some strange reason she remembers that as if it was yesterday. i took your grandmother to see epsie's grave about 2 months ago and as soon as we pulled up at church she immediately knew why we were there. i stood there and cried because of epsie and how brutally she was murdered and then i looked at your grandmothe (my sister) and all i could do was cry. Its sad for all involved and im not gonna stop until i get justice for epsie...she deserves that and nothing else.

OUR JUSTICE SYSTEM NEEDS TO BRING PREDATORS SUCH AS THESE TO A SWIFT AND SPEEDY TRIAL. LIFES ARE ALTERED AND NEVER THE SAME AFTER A TRAGEDY SUCH AS THIS. WE NEED TO STAND BEHIND AND VOTE FOR OFFICIALS THAT ARE CHRISTIANS AND BELIEVE THAT JUSTICE SHOULD PREVAIL. I visited Epsie Lou in the hospital just before she died and prayed for her.... Had I not known who was laying in that bed I could have never recognized Epsie. She wA shown NO MERCY...Those animals who did this to her should not have any mercy either...Also I hope each one who had any part of bringing these animals into Epsie's life.never forgets what their actions caused until the day They die...Justice for Epsie Lou....Linda Moon

I have known parts of the Ewing family for more than 15 years and love them dearly. It is very upsetting knowing that if a suspected criminal or any other "regular" person misses a court date, they get fined. Why can't this hold true for the attorneys as well? 3 years is entirely too long and the family needs closure. They deserve at least that much!

thank you linda and yes are so right, if i had not been told that that was my sister epsie ln that bed i would have never recognized her, and it was so sad and i will forever remember how awful she looked and how badly she was beaten, Those are not men, they are monsters. If you remember we had to have a closed casket. thank you for helping her family to be a voice for her and please get all your friends to go to this site and leave a comment. I dont want anybody to forget what happend on that dreadful day back in 2009 and still no justice for Epsie. Our lives will never be the same without her sweet smile and her children and grand children miss her so much, so now instead of going to her home we now go to her gravesite. we all know that as christians that she is with God and she is in no more pain but what hurts is the pain that she endured to get there.

Our justice system needs to rethink and get the real meaning of JUSTICE!! I remember hearing about this brutal attack. I didn't know who they were till a little over a year ago. I have met the most wonderful friend I love dearly. Ms. Faye and her family need closure peace as do her sister and brother-n-law as well who are no longer able to speak for themselves dwn here with us. For they are with GOD living. The guys who did this to this family need to pay for what they did. Our justice system is allowing them to run free. I know their real judgement will come when GOD does. Till then my dear friend and her family live daily with no peace, comfort, or JUSTICE!!! I pray to our heavenly father for this family to allow justice for them and to Epsie and her husband. Love you Ms. Faye!!!

unfortunately the truth died with her, and we will never know for sure what happened to our sister that day and why it happened, but god sees it all. I know she was a mother, a grandmother, a great grandmother and one of the sweetest sisters anyone could ask for and we miss her everyday. I want justice for my sister, she deserves that, and i promised her before she died that we would not stop until we found out what happened that day and why it happened to her. I do know that she loved god and that she is at peace now and i take comfort in that, but it doesn't stop me from missing her. she will always be missed
